Track submission terms
These rules only cover submitting tracks to radio.kusy.net's air - technical requirements for the file, licensing and moderation. For account and voting rules, see /regulamin.
1. Scope of these Terms
These Track Submission Terms (the "Terms") set out the rules for submitting music tracks for broadcast on the radio.kusy.net service, as well as the rules for creating and verifying artist profiles.
These Terms supplement the Terms of Use of radio.kusy.net (the "General Terms") and apply solely to the process of submitting Tracks. All other use of the Service is governed by the General Terms.
To submit a Track, you must have an Account in the Service for which the current version of the General Terms has been accepted.
2. Who may submit tracks and how often
Tracks may be submitted only by logged-in Users with an Account that has not been blocked.
Each Track submission requires a separate acceptance of these Terms and the making of the declarations listed in section 5, regardless of any earlier submissions made from the same Account.
A single Account may submit no more than 3 Tracks per calendar week, counted from Monday (00:00) to Sunday (23:59), Warsaw time. The limit includes submissions awaiting moderation and accepted submissions; rejected submissions do not count.
Once the weekly limit has been used, the submission form tells the User from which day (the next Monday) another submission is possible. Submissions over the limit are not accepted.
Regardless of the weekly limit, the Service may apply additional limits on the number of submissions to protect the moderation process, in particular a limit on the number of submissions from one Account awaiting moderation at the same time. The User is informed in the submission form when such a limit has been reached.
The submission limits described in this section do not apply to material added by the Operator and the Service administrators authorised by the Operator. The Operator reserves the right to change the weekly limit by amending these Terms.
3. Technical requirements for the submitted file
The submitted audio file must be in MP3 format.
The maximum size of the submitted audio file is 10 MB.
The track must be between 30 and 300 seconds (5 minutes) long, and the minimum accepted bitrate is 96 kbps. Submissions that do not meet these conditions are rejected automatically before being passed to moderation.
The Service primarily accepts for broadcast Tracks of a standard radio length of around 3–4 minutes. Tracks that are clearly shorter or longer, while within the technical limits above, may be accepted for broadcast only exceptionally, at the moderator's discretion; a significant departure from the standard length may on its own be a reason for rejecting the submission.
An optional cover image in JPEG, PNG or WebP format, up to 8 MB before compression, may be attached to the submission, or one of the suggestions found automatically in the iTunes service based on the title and artist may be selected. The cover will be resized and embedded in the audio file's metadata.
The Operator reserves the right to change the above technical limits by amending these Terms.
4. Information provided with a submission
When submitting a Track, the User provides: the track title, the artist (selected from the User's own artist profiles or created during the submission), the music genre or genres, an optional description, optionally the name of the artificial intelligence tool used, information on whether the content is intended for adults only, and optional links to the track on external platforms (up to 5 links, one per platform, from a closed list of supported services).
5. Submitter's declarations
When submitting a Track, the User makes the following declarations, each confirmed separately:
a) a declaration of being at least 18 years old or acting with the consent of a legal guardian;
b) a declaration that the submitter holds the copyright to the submitted Track or a licence entitling them to distribute it within the Service to the extent necessary for broadcasting it on air;
c) a declaration that the submitted Track is not subject to collective management of copyright or related rights by a collective management organisation (e.g. ZAiKS, STOART, SAWP, ZPAV);
d) a declaration of holding commercial rights to use the content generated with the indicated artificial intelligence tool, in accordance with that tool's terms;
e) a declaration of having read and accepted these Terms and of having read the Privacy Policy;
f) an optional declaration as to whether the Track was created wholly or partly using artificial intelligence tools.
The declaration in point b) also covers the cover image attached to the submission, regardless of its source – embedded in the audio file, uploaded by the User, or selected from the suggestions found by the Service via the iTunes Search API (Apple). Suggestions from the iTunes Search API are offered only for convenience and do not constitute a grant by the Operator or by Apple of any rights to the artwork used – responsibility for holding the rights to the selected cover rests entirely with the submitter, as with all other elements of the submission.
The wording of each of the above declarations, as presented to the User at the time of submission, is archived together with information on the date and manner in which it was made and permanently linked to the given submission. Future changes to these Terms do not affect the wording or validity of declarations made earlier.
The User bears full responsibility for the truthfulness and completeness of the declarations made.
6. Artist profiles
When submitting a Track, the User may create an artist profile or assign the submission to an existing profile belonging to them.
A newly created or edited artist profile is subject to moderation on terms similar to the moderation of Track submissions.
The same artist name may be used by different Users in separate profiles – the Service does not guarantee exclusivity of an artist name between Accounts, unless ownership of the profile has been verified in accordance with section 7.
7. Verifying ownership of an artist profile
A User may request verification that they own a given artist profile by placing a one-time code generated by the Service in the publicly visible description of their YouTube channel.
Verification consists of the Service automatically checking whether the code is present in the publicly available description of the indicated channel. This process does not require logging in to a Google account or sharing any data from that account with the Service – only the publicly visible channel description is checked.
Successful verification results in the artist profile being marked as verified and assigned to the User's Account. An artist profile can be verified by only one Account.
8. Moderation of submissions
Every Track submission is reviewed by authorised Service moderators before being accepted for broadcast.
Moderation covers the submission data, the content of the declarations made, compliance with these Terms and the law, and any similarity to tracks already submitted.
A moderator may accept the submission, approving it for broadcast, or reject it, giving a reason for rejection visible to the submitter. If rejected, the submitted file is deleted from the Service's servers.
Submitting a Track does not give the User any claim to have it broadcast. The decision to put a Track on air rests with the Operator and the authorised moderators.
During moderation, access to the submitter's data (including their display name, e-mail address and the content of the declarations made) is limited to authorised Service moderators, for the purpose of reviewing the submission.
9. Removal of a track from air and appeals
The Operator reserves the right to take off air a Track previously accepted for broadcast, in particular upon learning of an infringement of third-party rights, the withdrawal of consent by the rights holder, or a breach of these Terms or the law.
The submitter is informed of the removal of a Track from air by an e-mail stating the reason for the decision and containing a one-time link to an appeal form, available without logging in.
Appeals are considered by the Operator or an authorised moderator, and the User is informed of the outcome by e-mail.
10. Submitter's liability
The User submitting a Track bears sole responsibility for the submission being consistent with the facts and the law, including the truthfulness of the declarations listed in section 5.
Where a false declaration has exposed the Operator to damage, including third-party claims relating to infringement of copyright or related rights, the User is liable for the damage caused on the general terms provided by law.
Irrespective of liability for damages, making a false declaration may result in the Track being taken off air and the Account being blocked in accordance with the General Terms.
11. Changes to these Terms
The Operator reserves the right to amend these Terms, in particular in the event of changes to technical requirements, moderation rules or the law.
A new version of the Terms applies only to Track submissions made after the date on which it enters into force. Submissions made earlier remain bound by the declarations made under the version of the Terms in force at the time of submission and do not require re-acceptance.
