General terms

These rules apply to everyone who creates an account, votes or otherwise uses radio.kusy.net. Submitting tracks has its own terms - see /regulamin-zgloszenia.

This is an English translation provided for convenience. In case of any discrepancy, the Polish version is binding. Read the Polish version

1. General provisions

These Terms set out the rules for using the website available at radio.kusy.net (the "Service"), including the rules for creating and maintaining an account, voting on tracks, and the liability of the Operator and Users.

The Service is an internet radio station presenting music tracks created with the help of artificial intelligence tools, together with voting, artist profiles and track submissions by Users.

The rules for the process of submitting tracks for broadcast, including the submitter's licensing declarations, are set out in a separate document: the Track Submission Terms. Both documents apply jointly to track submissions.

The rules for processing Users' personal data are set out in a separate document: the Privacy Policy, available at /polityka-prywatnosci.

Matters not governed by these Terms are subject to Polish law, in particular the Civil Code and the Act on the Provision of Electronic Services.

2. Definitions

Operator – Rafał Kusy, a natural person not running a registered business in this respect, who operates the Service and makes decisions about how it works.

User – a person using the Service, in particular a person with a registered Account.

Account – the set of resources and permissions assigned to a User in the Service, available after logging in.

Track – a music file submitted by a User for broadcast on the Service's Stream.

Stream – the Service's audio stream, publicly available at radio.kusy.net/stream.

3. Operator and contact details

The Service is run by Rafał Kusy as a private individual, not running a business in this respect.

The Operator can be contacted by e-mail at radio@kusy.net.

All requests, including complaints, requests concerning personal data and reports of infringements, should be sent to the above address or through the forms available in the Service.

4. Registering and maintaining an Account

Creating an Account requires providing an e-mail address, setting a password and a display name, and then confirming the e-mail address via an activation link, unless the Account is created through the external login described in section 5.

To create an Account, you must read and accept these Terms and the Privacy Policy. An Account cannot be created without accepting these Terms.

Users' passwords are stored in the Service only in hashed form (a salted hash function) and are not known to the Operator in plain text.

Users must keep their login details confidential and are responsible for actions taken using their Account, unless these resulted from circumstances beyond the User's control.

Users may request the deletion of their Account at any time by contacting the Operator. The rules for data retained after an Account is deleted are set out in the Privacy Policy.

5. Logging in with a Google or Discord account

The Service allows you to create an Account and log in using an external Google or Discord account (OAuth login).

In that case, the Service retrieves from the User's profile with the given provider only the data needed to create and identify the Account: a stable account identifier, the e-mail address and information on whether it has been confirmed. The Service does not gain access to the User's password with the given provider or to any other data in their Google or Discord account.

Logging in via Google or Discord is equivalent to creating an Account in the Service and requires acceptance of these Terms on the same basis as registration with an e-mail address and password.

Details of the scope of data transferred and the legal bases for this processing are described in the Privacy Policy.

6. Rules for using the Service

Listening to the Stream and browsing the Service's public content (track list, artist profiles, ranking) is possible without creating an Account.

Submitting tracks, voting, creating and editing artist profiles and using profile ownership verification require an Account and acceptance of the current version of these Terms.

It is prohibited to attempt to circumvent the Service's security measures, to artificially generate votes or plays, to create multiple Accounts in order to circumvent the Service's limits, and to engage in any activity that is unlawful or infringes the rights of third parties.

The Operator reserves the right to monitor Account activity for suspicious patterns (e.g. multiple Accounts voting from the same IP address) solely to prevent abuse, in accordance with the rules described in the Privacy Policy.

7. Voting and credits

A logged-in User may vote on Tracks broadcast on the Stream by giving them one of the available ratings.

Each Account has a daily pool of credits entitling it to vote, renewed automatically once a day. The Operator may change the size of the daily credit pool and the daily limit of votes per IP address.

The Service does not verify the User's age when an Account is registered or when voting. Use of the Service requires being at least 18 years old or acting with the consent of a legal guardian, in line with the declaration made when submitting Tracks.

The Operator reserves the right to invalidate votes cast in a manner bearing the hallmarks of abuse, after recording this decision in the internal moderation register.

8. Submitting tracks and artist profiles

The rules for submitting Tracks for broadcast on the Stream, including technical requirements, the submitter's required declarations, the rules for creating artist profiles and the moderation process, are set out in the separate Track Submission Terms.

The Track Submission Terms are accepted separately with each Track submission; their acceptance neither replaces nor is replaced by acceptance of these Terms.

9. Moderation and sanctions

The Operator and the moderators authorised by the Operator may make decisions concerning content submitted to the Service and Users' actions, including decisions to reject a submission, take a Track off air, or temporarily or permanently block an Account.

An Account may be blocked in particular in the event of a breach of these Terms, the Track Submission Terms or the law, including where false declarations were made when submitting a Track.

Moderation decisions concerning submissions and artist profiles are recorded, with reasons, in an internal, unmodifiable register of moderation actions.

A User whose Track has been taken off air has the right to appeal on the terms described in the Track Submission Terms.

10. Operator's liability

The Service is run by a private individual, free of charge, as far as the Operator's available time and technical means allow. The Operator makes efforts to keep the Service running continuously and without disruption, but does not guarantee uninterrupted availability of the Service or the Stream.

The Operator is not liable for the content of Tracks submitted by Users to the extent that such liability rests with the submitter under the declarations made on the basis of the Track Submission Terms.

The Operator is not liable for damage resulting from the use of or inability to use the Service, unless the damage was caused intentionally by the Operator, to the extent permitted by applicable law.

11. Notice of planned changes to the Service

The Operator is considering introducing in the future the option for Users to voluntarily support the Service, including through external creator-support platforms (e.g. Patronite or similar).

The Operator is also considering the possibility of introducing in the future advertisements broadcast on the Stream or displayed on the Service's pages.

Any of the above features will be introduced with adequate advance notice, preceded by an update to these Terms and, to the extent it involves new processing of personal data or new cookies, an update to the Privacy Policy, before the feature is actually launched.

12. Personal data and cookies

The rules for processing Users' personal data and the use of cookies in the Service are set out in the Privacy Policy, available at /polityka-prywatnosci.

13. Complaints

Users may submit complaints about the operation of the Service to radio@kusy.net, describing the problem and providing contact details.

The Operator considers complaints within a reasonable time and replies to the e-mail address from which the complaint was sent or the one assigned to the User's Account.

14. Changes to the Terms

The Operator reserves the right to amend these Terms, in particular in the event of changes to the Service's functionality, changes in the law or the introduction of the features described in section 11.

Registered Users will be informed of a planned change to the Terms by an e-mail sent with adequate notice before the date on which the new version enters into force, stating that date and where the full text of the changes is published.

From the date the new version of the Terms enters into force, a User with an Account must read and accept the new text at their next login. Until the new version is accepted, access to the features requiring login listed in section 6 (submitting tracks, voting, creating and editing artist profiles, profile ownership verification) may be temporarily restricted, while listening to the Stream and browsing the Service's public content remain available without acceptance.

If a User does not accept the new version of the Terms, they may stop using the Service at any time and request the deletion of their Account in accordance with section 4.

A change to the Terms does not affect declarations made by the User in earlier Track submissions under an earlier version of the Track Submission Terms – these remain in force in the wording applicable at the time they were made.

15. Final provisions

These Terms and the use of the Service are governed by Polish law.

If any provision of these Terms proves invalid or ineffective, the remaining provisions remain in force.
